Our terms and conditions of trade.



Acceptance of users

Phiten Performance Ltd. may, in its sole discretion refuse service to anyone at anytime.

Delivery

Delivery is free within New Zealand for all orders and generally by NZ Post standard postal service. Orders over $250 will generally be ungraded to either a tracked parcel or courier service.  This policy can be changed at any time.

Unless you are advised otherwise, delivery will be approximately 3-5 working days after placement of order.  If  items are not in stock in our New Zealand warehouse, these will be sourced  from Japan and delivery may take 2-3 weeks.

You will be advised of any unexpected delay.

Guarantee

If you are not satisfied with the products you receive from the Phiten Performance Ltd website you can return them within 10 days of receipt of the order, provided they are in original condition and packaging. We will send you replacements or refund the purchase price less delivery costs incurred by Phiten Performance Ltd. To return please repackage and affix appropriate postage.

International Delivery

Phiten Performance Ltd does not accept international orders.

Exclusion and/or Limitation of Liability

  • Phiten Performance Ltd will not be liable for any loss or damage whatever due to failure by Phiten Performance Ltd to deliver the products (or any of them) promptly or at all.
  • Phiten Performance Ltd will be under no liability to any purchaser of products or services or to anyone making use of this site , in respect of any indirect or consequential loss or damage which may be suffered or incurred or which may arise in respect of the products or services supplied by us through Phiten Performance Ltd and/or this web site and/or in respect of any failure or omission on the part of Phiten Performance Ltd to comply with its obligations under any agreement reached for the supply of product or services TO THE INTENT that under no circumstances shall the liability of Phiten Performance Ltd (from any cause whatsoever) exceed the agreed purchase price for the product or services to the extent that such agreed purchase price shall have been paid.

Processing of Returns

Phiten Performance Ltd cannot accept liability if your return is damaged or goes missing. We will only refund postage costs when the return is the result of our error. It takes a maximum of 14 working days to process a return.

Remittance Terms

Your Credit Card will be charged at the time you order and delivery will be made as per our delivery policy. For direct banking customers, payment is required by Phiten Performance Ltd prior to shipping orders. Your order will be despatched forthwith upon payment being received into our nominated bank account.

Damaged or Defective Goods - Refunds

If your order arrives damaged or defective or we have sent you the incorrect product or the incorrect quantity, please contact us at phiten@xtra.co.nz or phone 027 574 4836.

Subject only to you satisfying us of the circumstances and subject also to the return within 10 days of the date of receipt of all or any products that you seek to have replaced, exchanged or for which a refund is sought, we will replace, exchange, or provide you with a refund, up to the value of the affected goods.

Secure Payment

We know of no documented cases of credit card fraud using our shopping system over the Internet.

All credit card payments are processed by DPS - Direct Payment Solutions.

All credit card numbers are encrypted in the software when the order is placed using 168bit encryption.

They are only decrypted after they reach DPS's systems.

They are not held in clear text on any web site and they are not divulged to the store owner.

Collection of Information

The customer authorises Phiten Performance Ltd to collect, retain and use, personal information for the purposes of:- Assessing customer creditworthiness Undertaking any dealings or transactions with the customer Enforcement of any legal or other rights Phiten Performance Ltd may have against the customer at the entire discretion of Phiten Performance Ltd. Sending the customer advertising or any other promotional material Collection from Other Sources The customer further authorises Phiten Performance Ltd to collect personal information from themselves, or any other source available to Phiten Performance Ltd, including, but not limited to, credit referral agencies, their bank and any other suppliers of product and services to them, for the purpose of assessing creditworthiness.

Rights of Refusal
The customer is aware that in the event that there is insufficient personal information supplied, or the information obtained is not satisfactory to Phiten Performance Ltd, at its sole discretion, then Phiten Performance Ltd, or any of its suppliers, may choose not to complete transactions with the customer.

Information Retention
The customer is/are aware that personal information supplied will be retained by Phiten Performance Ltd and will be accessible by Phiten Performance Ltd for or in relation to any of the purposes listed in the Collection of Information Clause above, for a reasonable period.

Correcting of Personal
Information Phiten Performance Ltd will facilitate any request made by the customer to access personal information held by Phiten Performance Ltd. The Customer may request any correction to personal information held by Phiten Performance Ltd and this request will be attached to the information held. The customer agrees to pay Phiten Performance Ltd reasonable costs on a time and attendance basis in complying with any such requests.

Opt-out from direct marketing database
The customer has the right to remove their name from Phiten Performance Ltd direct marketing database. The direct marketing database is used solely to provide information to customers about Phiten promotions and new Phiten products.

The customer can ‘Opt Out’ by contacing us at phiten@xtra.co.nz or 027 574 4836 and requesting to removal from our communication database.
